Medical cannabis has been more easily accessible in Switzerland since 2022, a major step forward for many patients. But while cannabis on prescription is now legally available in pharmacies, a complicated legal tug-of-war often begins for the drivers among the patients. Anyone who thinks the prescription is a free ticket risks having their driving license revoked and incurring high costs.
But is driving with medicinal cannabis now permitted in Switzerland?
The question is not easy to answer with a yes or no, as the right to treatment and the strict zero-tolerance regulations of Swiss road traffic law collide here. If you want to drive with cannabis containing THC, you have to be prepared for a complex path.

The Swiss Road Traffic Act (SVG) is tough: there is an absolute zero tolerance for certain drugs, including THC (tetrahydrocannabinol). If the analytical limit of 1.5μg/L THC in the blood is exceeded during a test, you are considered unfit to drive.
However, there has been a crucial but deceptive article in the law for cannabis patients since 2022: Article 2 para. 2ter of the Traffic Licensing Ordinance (VZV) states that zero tolerance does not apply if a medicine containing THC is prescribed by a doctor.
What does this mean in practice?
This exception does not mean a free pass. It merely removes the THC blood value from the automatic conviction. Instead, the authorities shift the focus to a much more expensive and time-consuming question: are you fit to drive?
After pre-breeding, the most exciting phase of cultivation begins: the transformation of tender little plants into strong flower suppliers. During this time, the focus is on targeted growth, plant care and a finely tuned microclimate.
Vegetative phase: structure, strength & preparation
In the so-called vegetative phase, the plants develop their root system further, grow in height and form the foundation for successful flowering. What counts in this phase:
Even growth: Every plant should become stable, bushy and strong.

Blooming phase: grafting begins
As soon as the plants are ready, the light pattern changes and the flowering phase is initiated. Now it's all about fine-tuning:
Nutrient balance: The supply of macro and micronutrients is essential to promote aroma, potency and resin formation.
Light quality: High-quality LED systems simulate the perfect sunlight, energy-efficient and plant-friendly.

Then the first trichomes shine, terpenes exude their aromas and the flowers ripen, each of them unique and cultivated with the utmost precision.
If you want to remain mobile as a patient, you must actively prove your fitness to drive in accordance with the aforementioned law. The road traffic office in your canton of residence will usually order a traffic medical report. Without a positive report, your driver's license is at great risk in the event of a check (despite a prescription).
The report essentially checks these critical points:
Stable therapy: The therapy must be set at a stable, chronic dosage. The acute, intoxicating effect of THC must no longer occur after the initial habituation process.
Cognitive performance: There must be no impairment of perception, reaction time, coordination or concentration.
No addiction problem: It must be ruled out that consumption is out of control or that there is a risk of addiction.
Important to know: Such expert opinions are a considerable financial burden for patients. Expect to pay several thousand francs (health insurance usually does not pay). The procedure can take months, sometimes even over a year.
This means that, despite the exempted THC blood value, the path is not an easy one if you want to continue driving as a patient.
Even if you comply with all regulations and aim for a positive test result, an ordinary traffic check can be unpleasant.
If the rapid drug test is positive, the police can act immediately, regardless of your prescription:
Preventive withdrawal of driving license: If you test positive and are suspected of being unfit to drive, your driving license can be temporarily withdrawn (precautionary withdrawal). Road safety always takes precedence here.
Blood sample and costs: A blood sample is taken, the analysis of which and the associated procedural costs must initially be borne by you. As the legal situation is so uncertain and the consequences so drastic, the Medical Cannabis Association Switzerland (MedCan) strongly advises patients to obtain comprehensive information and to be cautious when in doubt. If you don't want to risk your driving license, you should leave your vehicle parked until your therapy is stable and you have a positive traffic medical report.
No matter whether you have an expert opinion or a prescription, the top priority is always to be fit to drive. Only drive if you feel one hundred percent fit.
When do you have to leave the car behind? Never drive if any of the following points apply:
1. When starting therapy or adjusting the dose: Your body needs time to get used to the THC. Wait until you have developed a stable routine over a period of weeks.
2. In case of acute effects: If you feel tired, dizzy or noticeably intoxicated, you are obviously unfit to drive - remember, this is a criminal offense.
3. Combination with other substances: Avoid combining cannabis containing THC with alcohol, certain painkillers or other medications that can impair your ability to drive.
Documentation is everything
As a driving patient, always carry these important documents with you:
● Your current narcotic prescription.
● The medical confirmation of the chronic, stable dosage.
● Ideally: Your positive traffic medical certificate.
