For the use of this website and the business relationships between Sainfort Production GmbH, Wiesenstrasse 36, 8952 Schlieren (hereinafter Sainfort) and its customers, the following General Terms and Conditions (GTC) apply in the currently available and valid version when the website is called up or when goods are ordered.

Any natural or legal person who maintains a business relationship with Sainfort is referred to as a customer. The terms and conditions, the delivery and payment conditions as well as the data protection regulations can be adjusted from time to time. Sainfort asks you to read these provisions carefully each time you visit the website and each time you order goods.

These terms and conditions apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of Sainfort in order to be valid. When using this website or when ordering goods, the customer confirms that they fully accept these General Terms and Conditions, including the terms of delivery and payment.

Should individual provisions of these General Terms and Conditions prove to be ineffective or unenforceable or become ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected.

Our offers are non-binding in terms of price, availability and delivery times. We only ship/sell our products to people over the age of 18 and within Switzerland. Sainfort rejects any liability for non-compliance with our terms and conditions. Payments made which have violated our terms and conditions will not be refunded.

Unless otherwise stated, Sainfort's prices include statutory value added tax and any tobacco taxes. The prices include 7.7% VAT. in Swiss francs (CHF). Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved. In particular, Sainfort can make price changes at any time and without prior notice. The sales prices do not include any consulting and support services.

conclusion of contract

The offers on this website represent a non-binding invitation to the customer to order products and/or services from Sainfort. With the order via this website including the acceptance of these terms and conditions, the customer submits a legally binding offer to conclude a contract.

Sainfort then sends an automatic "order confirmation" by email, which confirms that Sainfort has received the customer's order. Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. The contract is concluded as soon as Sainfort sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.

If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, Sainfort is entitled to withdraw from the entire contract or part of it. If the customer's payment has already been received by Sainfort, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Sainfort is not obliged to make a replacement delivery in the event of a contract termination.

Payment options and retention of title

The payment options specified in the ordering process are available to the customer. Sainfort reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment.

If the customer defaults on payment, Sainfort can charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder. The products delivered to the customer remain the property of Sainfort until full payment has been made.

Delivery, obligation to check, notification of defects and return

Deliveries are sent by A Mail Priority or courier service to the address specified by the customer in the order. With the shipment, benefit and risk are transferred to the customer, insofar as this is legally permissible. Sainfort is not obliged to provide proof of shipment. If the goods are lost during shipping, the provider cannot be held liable.

If the delivery cannot be delivered or if the customer does not pick it up, the additional shipping costs and a processing fee of SFr. 20 to be borne by the customer. A new dispatch takes place only after receipt of payment. Sainfort can terminate the contract after notification of a complaint by email to the customer and setting a reasonable period of time.

The customer is obliged to check the delivered goods immediately, but no later than 5 working days after receipt of the goods (in the case of cuttings within 24 hours after the first delivery attempt) and to report any defects immediately by e-mail (including photo) to ---- Report to. After this period, returns are no longer possible.

Returns to Sainfort are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address given by Sainfort in the imprint. Returns without prior contact with us will not be processed and are deemed to have been delivered.

If the inspection by Sainfort shows that the goods do not have any detectable defects or that they are not covered by the manufacturer's guarantee, Sainfort can charge the customer for the activities, the return shipment or any disposal.

warranty

The statutory warranty is expressly excluded. Any warranty claims by the customer are limited to the scope of the manufacturer's warranty.

In the case of timely and justified notifications of defects, it is at Sainfort's discretion to provide compensation in the form of free repairs, an equivalent replacement or a refund of the purchase price. Further claims are excluded.

It is not possible for Sainfort to provide any assurances or guarantees that the data is up-to-date, complete or correct, or that the website, its functions, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties that are not owned by Sainfort.

Liability

Sainfort excludes all liability, regardless of its legal basis, as well as claims for damages against Sainfort and any auxiliary persons and vicarious agents. The consumption or application of the products offered by Sainfort is at the customer's own risk. Any liability is also excluded in the event of misuse of the products.

According to the Swiss Medicines Ordinance, any promises of healing are prohibited and we are not authorized to provide information about the healthcare system. The CBD products are not intended for the cure of diseases, prevention and diagnosis. Please consult your doctor before consuming CBD products. CBD must not be associated with mucous membranes.

In particular, Sainfort is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or unlawful intent.

Sainfort only uses hyperlinks to make it easier for the customer to access other websites. Sainfort can neither know the content of these websites in detail nor assume liability or any other responsibility for the content of these websites.

data protection

Sainfort may process and use the data recorded as part of the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data required for the performance of the service can also be passed on to commissioned service partners (logistics partners) or other third parties.

Further instructions

Sainfort expressly reserves the right to change these General Terms and Conditions at any time and to put them into effect without prior notice. In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law norms. The UN Sales Convention (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is Schlieren in the canton of Zurich, unless the law provides for mandatory places of jurisdiction.
